1. Who we are

HM4 Galleries is a service of HM4 Development ([legal entity name and address]) (“HM4”, “we”). These terms cover your use of HM4 Galleries as a photographer or studio (“you”). Your clients who view galleries are covered by our Privacy Policy, not by these terms.

2. Your account and studio

You need an HM4 account to use the console. You are responsible for what happens under your account and for the people you invite to your studio. Keep your sign-in secure and tell us at once if you think someone else has used it.

3. Trial, plans and payment

A new studio starts a free trial (currently 14 days and 5 GB). After the trial, uploading needs a paid plan; your galleries stay online for 30 days after the trial ends and then go offline until you choose one. Paid plans renew automatically each month or year until cancelled. Payments are processed by Stripe; we never see your card details. Prices exclude taxes unless stated. We may change prices with at least 30 days’ notice; the change applies from your next renewal.

4. Cancellation

You can cancel at any time from Plan and usage; the plan ends at the end of the period you have paid for, and we do not refund partial periods except where the law requires. After the plan ends, your galleries stay online for 30 days, then go offline. We keep your photos and settings for at least [90] days after that so you can come back or download them, and then may delete them.

5. Your photos

You keep all rights in the photos and content you upload. You give HM4 the permission it needs to store, process (for example resize and watermark) and show them as you direct, only to run the service. You confirm you have the rights to upload them, including the consent of people shown where the law requires it.

6. Acceptable use

Do not upload anything illegal, anything that infringes others’ rights, malware, or content sexualising minors; do not use the service to harass people, send spam, or attack or overload it. We may suspend a studio that breaks these rules or puts the service or others at risk, and will tell you why unless the law prevents it.

7. Availability and changes

We work to keep the service available and your data backed up, but the service is provided “as is” without a guarantee of uninterrupted availability. We may improve or change features; if we make a change that significantly reduces what a paid plan includes, we will give notice and you may cancel.

8. Liability

To the extent the law allows, HM4 is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits liability that cannot be limited by law.

9. General

These terms are governed by the laws of [jurisdiction]. We may update them; we will tell you of material changes at least 30 days ahead by email or in the console. Questions: [support email].
